Acceptance of Agreement. You agree to the terms and conditions outlined in this User Product Agreement ("Agreement") with respect to our site (the "Site"). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

General Service Terms. Our normal processing time is 7-10 business days, to deliver the business plan draft, after we have received all of the information necessary to complete the draft. By submitting information to  Wise Business Plans, client acknowledges that the information is true and correct, which may be used in the business plan. If any information provided is proprietary, copyrighted, or a registered trade mark, client represents that the information is owned by the client, or has the rights to use the information in their business plan. Wise Business Plans only bills our clients our fee to perform the service(s) selected; all State and Federal (IRS) filing fees are the responsibility of the client.

If the payment plan option is selected, you authorize us to process payment in 2 equal installments: 50% upfront and 50% before releasing or sending the initial draft of the work, or 30 days after the order has been placed, whichever comes first. This is automatically programmed into our payment system and any modifications to your payment cycle will incur a $50 processing fee. Some of our services have different payment plans in which we will follow the terms as defined in the service details of the invoice prepared by our sales department. The credit card billing will appear as Wise Business Plans for any purchase made within our network of websites. Please contact us at 800-496-1056 with any credit card billing questions. Insufficient funds on checks, credit card cancellations or charge backs will result in additional payment processing fees, delay of service order processing or ongoing support. You agree to pay an additional $50 for processing fees.

Failure to promptly correct past due balances will result in a $75 per month late fee, and after 60 days your account may be sent to a collection agency, for which you agree to pay all handling, collection and legal costs. Unresolved payment will also be reported to credit bureaus, Dun and Bradstreet and other business institutions.

When placing your order for our services please note that you will be given access to our proprietary tools in processing your order. Therefore, service orders are non-refundable and have a non-cancellation policy. In addition, cooperation and communication is needed to complete the business plan. If you are non-responsive for more than (10) ten business days, miss or reschedule more than (2) two appointment times with the writer, or we do not receive the completed business plan questionnaire within (10) ten business days of engaging our services, all monies are immediately due and payable and no refunds will be issued. At our discretion, based on individual circumstances, we may  offer a partial refund based upon the following steps of order completion: 1) if you cancel in writing prior to the first scheduled appointment with the writer, a cancellation fee of 25% of the total cost of the plan/service will be retained;  2) if you miss the first scheduled appointment with the writer, and then cancel in writing, a cancellation fee of 50% of the total cost of the plan/service will be retained; 3) if the first conversation with the writer has occurred, all fees will remain payable and due. Upon failure to pay or any other breach of this Agreement, we have the right to suspend performance of services pursuant to this Agreement by providing you with a five (5) day written notice of failure to pay in accordance with this Agreement. Such suspension shall continue until the event causing such suspension is cured or this Agreement is terminated pursuant to the terms hereof. The suspension of performance of services shall not cause any suspension of the term of this Agreement or your payment obligations hereunder. We may, in our sole and absolute discretion, terminate this Agreement effective immediately upon written notice to you in the event that (i) provision of services would be unlawful under any applicable law, ordinance, rule or regulation; (ii) obligation to perform services hereunder remains suspended for ten (10) or more business days; or (iii) failure to pay us all amounts and fees when due. You may terminate this Agreement only in the event that a material breach of this Agreement remains uncured by us for no fewer than thirty (30) days.  Upon termination of this Agreement, you shall immediately pay all amounts due hereunder. You shall not be entitled to any reimbursement, refund, or return of any amounts paid hereunder as a result of the termination of this Agreement.

Client acknowledges that they are in no way affiliated, associated with, employed by, or under independent contract with any other business plan consulting firm or any entity that could be interpreted as a competitor to Wise Business Plans. By engaging Wise Business Plans service, client agrees that this purchase is being solely used  for a personal business plan development. In the event that a connection is uncovered between client and a Wise Business Plan competitor, client relinquishes their right to arbitration or any form of legal action.

Client grants Wise Business Plans non-exclusive, worldwide, royalty-free rights and license to use client’s name, image and likeness (Excluding the Business Plan) for the purposes of promoting, marketing, and selling Wise Business Plans’ products and services.

Wise Portal. We offer a web-based service account (Wise Portal) available through the following online URL at //wisebusinessplans.com/shop/index.php/customer/account/login that allows you to use software developed and owned by Wise Business Plans and offered as a software as a service in order to upload, store, transmit, disseminate, print and otherwise distribute your business plan. Your use of the Wise Portal is at your own risk. The Service is provided on an AS IS and AS AVAILABLE basis. 

Professionalism. We value our customers and will work hard to earn your trust. We also treat our clients with respect and professionalism. However, we also value our employees who deserve the same respect and professionalism. All client communication is documented and we reserve the right to move a client to a different service representative or terminate the agreement at any time with uncooperative or abusive clients. In the event of this occurrence, we reserve the right to terminate our agreement and return 50% of the order total for incomplete work.

Customer Satisfaction. In the event of any dispute, claim, or disagreement arising from or relating to this agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. In the event of any disagreement, the concerns should be elevated to a customer service representative. This will create a record of the issue which will be escalated to management. If a resolution has not been reached within 48 hours, then you may contact management directly via email at our contact us page. Our goal is to discuss the matter in good faith, recognizing our mutual interests, and attempt to reach a just and equitable solution, satisfactory to both parties. We believe that as long as we are being reasonable, we will reach an agreement. Unfortunately, in a few cases we may not reach such solution; then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled only by the arbitration process administered by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules.

This agreement shall be governed by and interpreted in accordance with the laws of the State of Nevada. The parties acknowledge that this agreement evidences a transaction involving interstate commerce. The United States Arbitration Act shall govern the interpretation, enforcement, and proceedings pursuant to the arbitration clause in this agreement. Their decision is final, and Wise Business Plans will comply 100% with the final decision.

In no event shall an award in an arbitration initiated under this clause exceed the value of the product or service provided under this agreement. Each party shall bear its own costs and expenses and an equal share of the arbitrators and administrative fees of arbitration. The award of the arbitrators shall be accompanied by a reasoned opinion. Any arbitration' decision will be final. In the event any other recourse is taken outside the arbitration process to damage the company's (Wise Business Plans) reputation, this will be considered a malicious attempt of defamation of character in which our company reserves the right to file a civil suit in a Nevada court for damages, legal fees, and court costs. This includes any type of slander, such as verbal, BBB complaints, internet postings etc.

Product Terms

Business Plan. Our business plan, grant, marketing and proposal writers strive to prepare the most effective plan for your organization at an affordable price; however in order to do so we require that you provide quality, comprehensive information to be included therein. While we may advise you on what information may create greater opportunities for success, your business plan is ultimately a compilation of your company's approved processes and methods and thus the writer cannot facilitate your organization's business development and any opinion pertaining to business or organizational development is offered on a strictly voluntary and personal basis and not as a part of our service.

Please keep in mind that the success of the plan will be a direct result of the quality of information provided to our writers. As such, we cannot guarantee results on private foundations, government agencies, or any other party.

Our business grant services consist of an unsolicited business grant proposal which is not customized or targeted toward any specific grantor or funding program. Unsolicited business grant proposals are limited in scope and content, and will not include statements of need, program methodology, outcomes, evaluations, sustainability, or any other specialized grant proposal sections. For specific government grant please refer to the terms listed in the government grant section.

The financial projections as part of your business plan will be created based upon the information provided by the client. If you are unable to provide information on financial projections we will create your projections based on similarly structured businesses.

Included with all business plan, grant, marketing, and proposal services is one revision opportunity, subject to the following revision schedule: post-draft revisions are due in writing no later than fourteen (14) calendar days after the initial draft has been completed and emailed to you for review. If a revision request is not received within fourteen (14) calendar days we will assume that the draft is acceptable and will move forward with service completion. All requested post-draft revisions must be submitted at the same time. Revisions received or requested after the fourteen (14) calendar day period or each subsequent revision thereafter, will be completed subject to a revision fee starting at $299. Post-draft revisions are normally completed 2-5 business days after receipt.

Graphic Design & Branding. Branding your company involves the entire process in creating a unique name and image for your products or services in the consumers' mind. We can help accomplish this through customer graphic design work and marketing campaigns with a consistent theme. Branding aims to establish a significant and differentiated presence in the market that attracts and retains loyal customers.

Wise Business Plans offers a variety of graphic design solutions at very competitive pricing; however, all businesses are different with different needs, budgets, requests, competition, markets and goals etc. Therefore, it is not always possible to have a flat rate or one size fits all pricing model. Most of our services below are based on a 2-4 hour service and we reserve the right to re-price any initial quote once we have had our initial consultation and reviewed your needs. All quotes are for labor only, for printing and shipping quotes we can source a vendor for you based on quantities.

Customer graphic designs are subjective and can be very difficult to guarantee total satisfaction. To minimize any dissatisfaction it is critical that the client provide input on preferred colors, symbols, fonts, characters or special designs. We will then develop 3 distinct logo designs. Once we have a preferred logo design, we can fine tune with 2 additional revisions.   

Stationary Design Services. Our stationary design services will provide your business or organization with a customized layout of text and pre-selected graphics into one standard size (3.5" by 2") business card template (full color, front and back), as well as one standard size letterhead (8.5" x 11") and envelope (3 7/8" x 7 1/2"). All of these templates may be reproduced on the stock of your choice utilizing our printing services (for an additional fee), or any other printer you may wish to use. Your business card, letterhead, and envelope design may include basic contact information (name, address, telephone number, email address, etc.), or other self-defined content. Stationary design services do not include logo or additional graphic design services, and are limited to the creation of two proof samples per product, from which you may select one proof per product, per order. Additional proof samples requested will be priced at $75 each, per product. Changes to your selected proofs will be completed during the revision process and will be subject to the processes detailed below.

Included with all stationary design services is one revision opportunity, subject to the following revision schedule: requested revisions to your chosen proofs are due in writing no later than seven (7) calendar days after the initial proofs have been completed and emailed to you for review. Logo design services are limited to the creation of three proof samples per order, from which you may select one proof. Once we have a preferred logo design, we can fine tune with 2 additional revisions.

Article Writing. Our article writing service includes a 750 word maximum article. Should you want an article that exceeds this amount, additional fees will apply. Your article will be created based on the information that you provide in the "Article Questionnaire". The questionnaire will require that tell us the subject you wish article to be written about and if you have a specific story you wish we write about. Specific information that you wish to be included in your article, such as: website URL's, specific keywords and information, must be submitted in the "Article Questionnaire". Your article will be developed based on the guidance given by you in combination with the writer's research. You take full responsibility for the information in article that is provided on your behalf or lack of information as well as the accuracy of that information. Your service days will not begin until you provide all the information deemed necessary to complete your press release.

Once the initial information gathering is complete, an article draft will be created and sent to you for review and corrections. Please review it carefully, respond to any questions asked as thorough as possible, and return it by email with changes you would like. It may be necessary to go over the draft while talking by phone. While every measure will be taken to provide you with your ideal article, this is not an opportunity to completely re-write the release. Once any corrections or factual changes have been received, a final draft of the article will be created and sent by email to you. Review the final copy and once approved, you should send an email stating your final draft has been approved. Once this approval email is received, you will receive an electronic version of the article by email.

Press Releases (PR's). Our writers strive to prepare the most effective press releases for your company or organization; however in order to do so we require that you provide quality, comprehensive information to be included therein. Our press release writing service includes a 400 word maximum press release. Should you want a release that exceeds this amount, additional fees will apply. Your press release will be created from the information that you supply in the "PR Questionnaire". If needed, we will set up a time for a phone interview as part of the information gathering process, should inadequate information be provided in the questionnaire. While we may advise you on what information may be considered "more news-worthy", you take full responsibility for the information in the release, or lack of information as well as the accuracy of that information. Your service days will not begin until you provide all the information deemed necessary to complete your press release.

Once the initial information gathering is complete, a draft press release will be created and sent to you for review and corrections. Please review it carefully, respond to any questions asked as thorough as possible, and return it by email with corrections you would like. It may be necessary to go over the draft while talking by phone. While every measure will be taken to provide you with your ideal press release, this is not an opportunity to completely re-write the release. Once any corrections or factual changes have been received, a final draft of the release will be created and sent by email to you. Review the final copy and once approved, you should send an email stating your final draft has been approved. Consulting. Any additional support needed outside the scope of a project, such as extra content, research, or business consulting will be subject to an hourly charge of $195+ an hour, paid in advance.

Incorporation Services. Our incorporation services are limited to the preparation of documents for incorporation or organization in the jurisdiction of your choosing, and do not include any State or Local filing fees. These documents will fulfill the minimal legal requirements for incorporation/organization in your chosen jurisdiction, and are not meant to serve as formal operating agreements or bylaws for your business or organization. Any additional information or clauses which you wish to include in your organizing document will be incorporated therein, however, in order to assure that your filing will be successfully processed we reserve the right to advise you against any potential pitfalls and thus we cannot include information within your incorporating or organizing documents that would lead to your business or organization's organizing document not being successfully filed. As for advice on tax advantages our representatives are not trained to offer specific tax advantages and we cannot provide legal advice.

As we are not authorized to execute documents on behalf of your organization, we cannot make any legal filings on your behalf. Thus, all completed documents will be emailed to your email address on record with detailed instructions for filing.

e-Learning Resources. eBooks you purchase from WiseBusinessPlans.com are eligible for return and refund if we receive your request within seven days of the date of purchase. If an ebook does not perform as described, you may return it for a refund at any time. When a refund is granted, we’ll remove access to the eBook and your money will be returned. To submit a refund request, please contact elearning@wisebusinessplans.com. If an ebook becomes corrupted or requires replacement during the normal course of use, you can re-download it from your WiseBusinessPlans.com account. Refunds will not be granted in situations of purchase abuse. By using our services, including browsing our site, you promise to observe these principles.

You promise to respect copyright and otherwise observe the law. That is, you promise to not use the eBook that we have supplied other than on the terms upon which it was supplied to you.

You promise not to reproduce, transmit, make available, adapt, modify, frame (by whatever means), link to, forward, create derivative works based upon, distribute, disseminate, sell, publish, sublicense, or in any way commingle the Content with other third party content, do any other act of copyright, or otherwise use any of the material on the site without first obtaining the written permission Wise Business Plans (elearning@wisebusinessplans.com), or unless specifically permitted by the Copyright Act 1968 or similar copyright legislation.

You promise to pay for our products and services.

You promise to provide us with accurate information.

You promise to keep any eBook in the form in which it was supplied to you. We may include other information (including information identifying the author, the copyright owner, or the terms upon which the eBook is supplied) to any eBook supplied to you. You promise not to circumvent any measures that we have taken to protect the rights in the eBook that we have supplied, including removing this information or otherwise facilitating an infringement of copyright.

You promise not to compromise the integrity of our software or systems. That is, you promise not to use any device, software or routine to interfere or attempt to interfere with the proper working of the WiseBusinessPlans.com Website or any of the software that we supply to you for the purposes of providing you with an eBook.

One User Per Book. An important condition of the license is that, when you buy an ebook from WiseBusinessPlans.com, it can only be used by one individual. Lending and sharing is not permitted.

It is not permitted to buy one copy of an ebook and then load it onto multiple devices for several people to use. Nor can you load a book onto a device and then pass the device on to multiple individuals one after another. If you buy an ebook and give it to another person, it is theirs to keep for life. But they may not then lend or share it with another user.
